These Terms and Conditions govern your access to and use of the website, mobile application, and mobile fuel delivery services provided by Fuel Up LLC. By using our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.

1. Eligibility and Account Registration

  • You must be at least 18 years old to use our Services.
  • You represent that all information you provide is accurate, current, and complete.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

2. Services Provided

Fuel Up LLC provides on-demand and scheduled mobile fuel delivery services to residential and commercial customers in Ohio and other authorized areas. Services are subject to availability, weather, safety, and applicable laws. We reserve the right to refuse service for any reason permitted by law.

3. Orders, Pricing, and Payment

  • Prices are displayed at the time of order and may include fuel costs, delivery fees, service fees, and taxes.
  • By placing an order, you authorize Fuel Up LLC and its payment processors to charge your selected payment method.
  • Prices are subject to change without notice prior to order confirmation.
  • Failed or disputed payments may result in service suspension or account termination.

4. Delivery Requirements and Customer Responsibilities

You agree to:

  • Provide accurate delivery location and vehicle information.
  • Ensure the vehicle or fuel tank is accessible at the scheduled delivery time.
  • Ensure the correct fuel type is selected.
  • Comply with all safety instructions and local regulations.

Fuel Up LLC is not responsible for issues caused by inaccurate information, inaccessible vehicles, locked fuel caps, or incorrect fuel selection provided by the customer.

5. No Mixing or Misfueling Liability

Fuel Up LLC relies on customer-provided information regarding fuel type and vehicle compatibility. We are not responsible for damage caused by incorrect fuel selection provided by you, and you assume all risk related to misfueling due to incorrect or incomplete information.

6. Cancellations, Rescheduling, and No-Shows

Orders may be canceled or rescheduled subject to applicable cut-off times. A cancellation or no-show fee may apply if a delivery attempt is made and cannot be completed due to customer fault.

7. SMS and Email Communications

By providing your phone number and email, you consent to receive transactional and service-related communications.

  • Message frequency varies.
  • Standard message and data rates may apply.
  • Reply STOP to opt out or HELP for assistance.
  • We do not sell or share mobile numbers for third-party marketing purposes.

8. Prohibited Uses

You agree not to use the Services for unlawful purposes, interfere with our operations, provide false information, or attempt unauthorized access to our systems.

9. Intellectual Property

All content and materials related to the Services are owned by or licensed to Fuel Up LLC. You may not copy, reproduce, or distribute materials without prior written consent.

10. Disclaimer of Warranties and Limitation of Liability

  • Services are provided on an “AS IS” and “AS AVAILABLE” basis.
  • Fuel Up LLC disclaims all warranties to the fullest extent permitted by law.
  • Fuel Up LLC shall not be liable for indirect, incidental, or punitive damages.
  • Total liability for any claim shall not exceed the amount paid for the service giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless Fuel Up LLC from claims arising from your use of the Services, your violation of these Terms, or incorrect information provided by you.

12. Governing Law

These Terms are governed by the laws of the State of Ohio. Any legal action shall be brought exclusively in the state or federal courts located in Ohio.
